These Terms & Conditions ("Terms") govern your access to and use of the BigBell.ai website, platform, software, monitoring services, and related products and services (collectively, the "Services") provided by Goognu AI Labs Private Limited ("Goognu AI Labs," "BigBell.ai," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of an organization, company, or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, you must not use the Services.

You must not configure BigBell.ai to monitor systems or infrastructure that you do not own or have permission to monitor.
BigBell.ai may provide an optional monitoring agent that customers can install within their own infrastructure. The monitoring agent is deployed at the customer's discretion and with the customer's authorization. The agent may collect configured system-level metrics, including CPU utilization, memory utilization, system load, network metrics, and other supported metrics required for the monitoring functionality. You are responsible for:
BigBell.ai may periodically send requests to customer-configured URLs to determine availability and monitor HTTP response behavior. Alerts may be generated when a monitored endpoint does not meet the expected availability or response criteria configured by the customer. Monitoring services and alerts are provided as an operational aid and should not be considered a guarantee of continuous availability or detection of every possible failure. Monitoring results may be affected by network conditions, DNS issues, firewalls, third-party infrastructure, temporary connectivity problems, or other factors outside our control.
Customers may configure email addresses to receive monitoring alerts. Email addresses may need to be verified before alerts are sent to them. Customers are responsible for ensuring that they have appropriate authorization to add email addresses as alert recipients. Customers and authorized users may manage or remove alert recipients through the BigBell.ai console where such functionality is available. BigBell.ai is not responsible for delays, failures, filtering, or blocking caused by the recipient's email provider or infrastructure outside BigBell.ai's reasonable control.
BigBell.ai may provide AI-powered ChatOps functionality. AI-generated responses may be based on available monitoring information, user inputs, system information, or other data accessible to the feature. AI-generated output may be incomplete, inaccurate, or misleading and should not be treated as a substitute for professional judgment or independent verification. You remain responsible for reviewing and validating AI-generated information before taking operational, security, or business-critical action based on such information. The specific AI technologies and models used to provide ChatOps may change over time.

You retain ownership of Customer Data that you submit to or generate through the Services. You grant Goognu AI Labs a limited, non-exclusive right to process Customer Data solely as reasonably necessary to provide, maintain, secure, support, and improve the Services, or as otherwise permitted by applicable law or agreed with you. You are responsible for ensuring that your Customer Data and use of the Services comply with applicable laws and do not infringe the rights of any third party. Our processing of personal information is described in our Privacy Policy.
We use reasonable technical and organizational measures designed to protect Customer Data and the Services. Communications between relevant components of the Services may be protected using encrypted HTTPS/TLS connections. However, no online service or method of electronic storage can be guaranteed to be completely secure. You acknowledge that you use the Services at your own risk and that you are responsible for maintaining appropriate security practices for your own systems and accounts.
The Services, including the BigBell.ai platform, software, interfaces, designs, documentation, trademarks, logos, and other materials provided by us are owned by or licensed to Goognu AI Labs and are protected by applicable intellectual property laws. Subject to these Terms and any applicable subscription agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable right to access and use the Services during the applicable subscription period. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works of the Services except as expressly permitted by us or applicable law. You retain ownership of your Customer Data and content.
If you provide suggestions, ideas, or feedback regarding the Services, you grant Goognu AI Labs the right to use such feedback without restriction or obligation to compensate you, provided that such use does not disclose your confidential information or Customer Data.
The Services may interact with or depend on third-party infrastructure, networks, hosting providers, email providers, or other services. We are not responsible for the availability, performance, security, or functionality of third-party services that are outside our reasonable control. Your use of third-party services may be subject to their own terms and privacy policies.
If the Services are provided on a paid basis, applicable fees, billing terms, subscription periods, usage limits, and payment conditions will be communicated through the applicable order, subscription, invoice, or separate agreement. Unless otherwise stated, fees are non-refundable except where required by applicable law or expressly agreed in writing. We may suspend or restrict access to paid Services for overdue or unpaid amounts after providing reasonable notice, where applicable.
We aim to provide reliable and continuous access to the Services but do not guarantee that the Services will be uninterrupted, error-free, or available at all times. The Services may be temporarily unavailable due to:

To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability, except to the extent such warranties cannot legally be excluded. BigBell.ai does not guarantee that every outage, incident, security event, or system failure will be detected or that every alert will be delivered without delay.
To the maximum extent permitted by applicable law, Goognu AI Labs and its directors, officers, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, business opportunities, data, or goodwill arising from or related to your use of the Services.
To the maximum extent permitted by applicable law, the aggregate liability of Goognu AI Labs arising out of or relating to the Services or these Terms will not exceed the amount paid by you to Goognu AI Labs for the Services during the twelve (12) months immediately preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited or excluded under applicable law.
To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Goognu AI Labs and its officers, directors, employees, and affiliates from claims, damages, liabilities, losses, and expenses arising from:

Each party agrees to protect confidential information using reasonable care and to use such information only for purposes related to the applicable business relationship. We may modify these Terms from time to time. If we make material changes, we may provide notice through the Services or by other appropriate means. Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the revised Terms.
These Terms will be governed by and interpreted in accordance with the laws of India, without regard to conflict-of-law principles. Subject to any mandatory provisions of applicable law, courts located in India will have jurisdiction over disputes arising from or relating to these Terms or the Services. For enterprise customers, a separate written agreement may specify different governing law or dispute-resolution provisions.
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with the Privacy Policy and any applicable order form, subscription agreement, Data Processing Agreement, or other written agreement between you and Goognu AI Labs, constitute the agreement governing your use of the Services. If there is a conflict between these Terms and a separately executed written agreement, the separately executed agreement will control to the extent of the conflict.
